| | We intend to construct a garage on our property to replace a shed. We wish to apply for alley abandonment as on our lot we have a 50+ year old tree and if we have to build on the rear property line (rather than in the abandoned alley) we will be building very close to the tree and we are concerned that it will impact the long term viability of the tree. It is very important to us to try and retain this mature tree. Therefore, we want to utilize the 'alley' space which is already fully enclosed in our yard which would allow us to have a large enough set back from the base of the tree to ensure its survival for many years to come.
This 'alley' has had buildings built over both ends of it decades ago and as such there is currently no public right of way or even any way for people to access this land. Except for the fact it shows on the survey for our lot we would have no idea this alley even existed as the land is already enclosed within our back yard fence. In fact, the alley mid point is fenced down the entire length of the block with each abutting property having their 'share' of the alley enclosed in their yard already. Therefore, us utilizing this space will have no impact on any other property or any other individual's access to the 'alley'. |
